A voluntary
compliance plan is a formally adopted plan by healthcare providers
to facilitate conformity with the federal Medicare and Medicaid
fraud and abuse laws, the laws regarding billing and submission
of claims, and the Stark I and II Laws.
Through
the recent fraud and abuse enforcement efforts of the government,
it has become clear to the OIG (Office of Inspector General) that
improved internal controls in provider billing systems are needed
to monitor adherence to federal healthcare statutes and regulations.
The
following benefits may be gained from the implementation of a compliance
plan:
Improved
Performance - Your development process and the ongoing
monitoring of a compliance plan will allow all participants to
better understand how the practice actually functions. The additional
knowledge gained during the development and monitoring of a compliance
plan, will allow the practice to more effectively use resources.
Over the long term, proper function of a compliance program could
save you money and will facilitate a well-managed practice.
Ethical
Culture - The federal government expects providers to
self-police their practice and prevent any internal wrongdoings.
Compliance activities reduce the likelihood of a violation. A
compliance plan creates an "ethical culture" which improves the
image of your healthcare practice and wins the loyalty of employees.
Safeguard
Assets - A properly managed compliance program will assist
in the protection of corporate assets.
Reporting
System - A properly defined reporting system or "hotline"
can head-off external reporting of problems thereby allowing investigations
to be performed internally.
Response
System - A compliance plan creates a response system if
there is an internal investigation and establishes structure for
attorney-client privilege.
Mitigate
Penalties - Sincere attempts at the compliance program
may result in a mitigating factor and reduce penalties.
